1.General conditions
a) Trade acceptance. Our general terms are available for trade acceptance through hyperlinks featured on the reception page of our service and on the order confirmation page.
As a consequence, putting in an order implies the full acceptance from any customer of the present general conditions which will prevail, except specific stipulation agreed by both parties, on any other document, and in particular on our customer’s general purchase conditions.
2. Order
a) order validation : Our order module technically guaranties order authentication and integrity. It is expressly agreed that validation of order confirmation has the force of a signature, irrevocable consent, contract evidence and price knowledge.
Order confirmation will be electronically mailed. Our company will be committed by reception of this mail.
It is expressly agreed that electronic savings we hold may constitute a valid evidence mode whatever is the order amount.
b) Modification : No order modification will be possible after sending of the above mentioned order validation.
3. Products and services
Pictures and descriptions of proposed products and services are indicative and may undergo slight modification without involving our liability nor the reliability of the sale.
It is expressly agreed that our offers are to be understood within the limit of available stock.
Proposed products and services may be delivered in and out of France with all reserves due to custom limitation or interdiction in destination country.
The present general conditions are applicable wherever the customers is established. It is expressly agreed that the performed services is known as being made in France.
4. Sales price and delivery charges
Prices listed in our website are given all taxes included. Order cost is the one in effect at the date of its final registration.
Delivery charges are at customer’s expenses and will be charged in addition according to the order amount and in conformity with our price list.
All rates and taxes in accordance with French regulations or with regulations from the place of customer’s establishment or place of delivery are at customer’s expenses.
An invoice, mentioning VAT will be enclosed with the delivery.
5. Terms of payment
Goods will not be delivered before complete payment.
6. Claims
Customer accepts the risks related to the goods and their transport as soon as they leave the warehouse they are stocked in by us or our principals. It concerns in particular loss, breakage, damage or destruction risk.
All claim related to an apparent defect, or non conformity of the delivered product is to be sent by written mail within the limit of 7 (seven) days from the goods reception date. Customer is responsible for transmitting all eventual necessary reserves to the carrier within the legal time limit.
The customer expressly declares having received all the necessary information and advice from us regarding the proper use of the ordered good and renounces to seek our liability in that concern.
7 Delivery and product’s use
a) orders are delivered directly to the mentioned address within the best delay, depending on delivering means and nature of ordered products (Due to very low quantity availability of some products, delay might be extended.)
Our liability will not be involved due to a delay in delivery. Such a delay will not allow a contract cancellation or obligation for our company to pay any damages or penalty per day of delay.
b) Use of product is under reserve of legal guarantee provided by our principals, under the sole customer’s responsibility. Are notably excluded from our guaranty all damages related to a misuse, abusive use, defective installation or modification of the product.
8 Dispute settlement
The present contract will be liable to the French regulations
All dispute will be brought in front of the commercial court of Avignon, France.
